Pursuant to TEC §7.056 , this waiver allows the district to waive Texas Education Code §21.003, Certification Required; TEC §21.0031, Failure to Obtain Certification; Contract Void; and Texas Administrative Code §231.1(e), Criteria for Assignment of Public School Personnel, which states a person may not be employed as a teacher, teacher intern or teacher trainee, librarian, educational aide, administrator, educational diagnostician, or counselor by a school district unless the person holds an appropriate certificate or permit issued by the State Board for Educator Certification for his or her current assignment.
General State Waiver requests to waive the certification law are considered only for unique district campus populations; district needs; circumstances and/or unique certification requirements not currently covered by rule. The waiver will be for a defined period as a temporary fix to provide district compliance with current law and rule. The term of the waiver is for a maximum period of three years. If the waiver is granted, and without notification from the Texas Education Agency, it is expected the district will have taken action to ensure the district is in compliance with TEC §25.081, §21.003, TEC §21.0031 and TAC §231.1(e) without needing a General State Waiver. Exceptions will be considered on a case-by-case basis.

Dec. 1, 2021 is the deadline for submission of your 2021-2022 Annual Governance Reporting Form for Open-Enrollment Charter Schools. The Texas Education Agency (TEA) is statutorily required to collect information annually regarding open-enrollment charter school board members and school officers. Our analysis of these forms is vital for maintaining quality charter schools in Texas. Please note that if you do not submit your governance forms in a timely manner, you will receive “does not meet expectations” for the governance indicator on your Charter School Performance Framework report.

The Firm has completed updates to our Special Education Framework Policies. Our updates are based on new laws passed by the Texas Legislature during the 87th Legislative Session (2021) and on new interpretations released by TEA such as for students with dyslexia.
We have included redlined versions of the policies with substantive changes for those of you who have adopted our policies in the past. Also note that policy 6.27 was renumbered to 6.21, that 6.11 was divided into two policies 6.11 and new 6.28, that policy 6.9 was divided into two policies 6.9 and new 6.25, and that policies 6.21-6.29 were renumbered accordingly.
There is an October 29, 2021 deadline for LEA’s to upload all updated SPED policies and any accompanying procedures to the Region 18 Framework. Additional assistance in uploading can be found at https://www.esc18.net.
